This panel will cover one of New York State’s legislative proposals to address purchases of sovereign bonds issued under NY law with the intention to sue on those bonds (known as the champerty defense). Specifically, the panel will address what the proposed champerty amendment will do, what it means for the NY sovereign capital markets, what options the market has going forward (including incorporating “jurisdiction switch” clauses in sovereign debt contracts), and the UK government’s reaction to recent legislative proposals there.
