Waiver and Release of Claims

EMTA looks forward to welcoming you back to its in-person conferences.  Due to the extremely contagious nature of COVID-19, EMTA (and host location entity) has put in place preventative measures and precautions pursuant to guidelines from the U.S. Center for Disease Control (CDC), and local ordinance and regulations.  Such measures may include, among others, requiring “social distancing” to be maintained or the encouraged use of face coverings.

However, these measures cannot guarantee that participants in EMTA’s in-person conferences will not become infected with COVID-19.

For the safety of EMTA’s employees and guests, you may not attend an EMTA in-person conference if:

1. You are not vaccinated with a vaccine approved by the WHO or FDA;
2. You have experienced in the last 14 days any symptoms of COVID-19, which include fever, cough, shortness of breath or others as specified by the CDC;
3. You have been diagnosed with COVID-19 and have not yet received a test that you have been cleared as non-contagious by applicable health standards; or
4. CDC guidelines prevent your participation. See CDC for most recent guidance.

RELEASE AND WAIVER

I acknowledge that I receive educational and other benefits from participating in the EMTA in-person conferences, and I willingly engage in this event (the “Conference”).  I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST EMTA, THE HOST LOCATION ENTITY, AND THEIR RESPECTIVE AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING, BUT NOT LIMITED TO, DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING, BUT NOT LIMITED TO, DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE CONFERENCE.

ASSUMPTION OF RISK

I ACKNOWLEDGE AND UNDERSTAND THE FOLLOWING RISKS RELATING TO ATTENDANCE AT THE CONFERENCE:

ATTENDING THE CONFERENCE IN PERSON MAY POTENTIALLY EXPOSE ME TO INFECTIOUS DISEASES, INCLUDING COVID-19.  WHILE EMTA AND THE HOST LOCATION ENTITY TAKE REASONABLE PRECAUTIONS AS PRESCRIBED BY APPLICABLE REGULATIONS AND GUIDANCE TO REDUCE THIS RISK, I FREELY AND KNOWINGLY ACKNOWLEDGE AND ASSUME THE RISK THAT SERIOUS ILLNESS OR DEATH MAY OCCUR, EVEN IF ARISING FROM THE NEGLIGENCE OR FAULT OF THE RELEASED PARTIES.
